Acceptance of Terms
By accessing or using Operno, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these terms, you may not use our service.
- You must be at least 18 years old to use our service
- You must have the authority to enter into this agreement on behalf of your organization
- Your use of the service constitutes acceptance of any updates to these terms
Service Description
Operno provides a cloud-based work order management platform that helps service businesses:
- Create, track, and manage work orders
- Manage client information and relationships
- Schedule and assign jobs to technicians
- Generate reports and analytics
- Facilitate team collaboration and communication
We reserve the right to modify, update, or discontinue features with reasonable notice.
User Accounts
Account Creation
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately of any unauthorized use of your account
- One person may not maintain multiple accounts
Account Responsibility
- You are responsible for all activities that occur under your account
- You must ensure all users in your organization comply with these terms
- You must maintain current contact and billing information
Acceptable Use Policy
Permitted Uses
You may use Operno only for legitimate business purposes related to work order management.
Prohibited Activities
You may not use our service to:
- Violate any applicable laws or regulations
- Infringe upon intellectual property rights
- Transmit malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt our service or servers
- Use the service for illegal activities or harassment
- Reverse engineer, decompile, or attempt to extract source code
- Resell or redistribute our service without permission
Data Ownership and Usage
Your Data
- You retain ownership of all data you input into our platform
- You grant us permission to process your data to provide our services
- You are responsible for ensuring you have rights to all data you upload
- You must not upload confidential information belonging to third parties without permission
Our Rights
- We may use aggregated, anonymized data to improve our service
- We retain rights to our platform, software, and intellectual property
- We may use your company name and logo as a customer reference
Data Export and Portability
- You can export your data at any time through our platform
- Upon account termination, you have 30 days to export your data
- We provide data in standard formats (CSV, JSON) for portability
Payment Terms
Beta Period
- During the private beta, our service is provided free of charge
- Beta users will receive advance notice before any paid plans begin
- You may cancel your account at any time during the beta
Future Paid Plans
- Pricing will be per technician/user on a monthly subscription basis
- Payment is due in advance for each billing period
- We accept major credit cards and ACH transfers
- Prices are subject to change with 30 days notice
- No refunds for partial months or unused portions
Late Payment
- Accounts may be suspended for non-payment after 15 days
- A $25 late fee may be charged for overdue payments
- Data access is restored immediately upon payment
Service Availability
Uptime Commitment
- We strive for 99.9% uptime availability
- Scheduled maintenance will be announced in advance
- Emergency maintenance may occur without notice
Service Limitations
- Service may be temporarily unavailable due to technical issues
- We are not responsible for internet connectivity issues
- Third-party service dependencies may affect availability
Termination
Termination by You
- You may cancel your account at any time through the platform
- Cancellation takes effect at the end of the current billing period
- You remain responsible for all charges incurred before cancellation
Termination by Us
We may terminate your account if you:
- Violate these Terms of Service
- Fail to pay fees when due
- Engage in fraudulent or illegal activities
- Abuse our support team or other users
Effect of Termination
- Your access to the service will be suspended immediately
- You have 30 days to export your data before deletion
- All outstanding fees become immediately due
- Provisions regarding liability and disputes survive termination
Liability and Disclaimers
Service Warranty
Our service is provided "as is" without warranties of any kind. We do not guarantee that our service will be:
- Free from errors or interruptions
- Compatible with all devices or software
- Suitable for all business needs
- Available at all times
Limitation of Liability
- Our liability is limited to the amount you paid in the 12 months before the claim
- We are not liable for indirect, consequential, or punitive damages
- We are not responsible for data loss due to your actions
- You agree to backup your data regularly
Indemnification
You agree to indemnify and hold us harmless from any claims arising from:
- Your use of our service
- Your violation of these terms
- Your violation of any third-party rights
- Your data or content uploaded to our platform
